 4. VIRTUAL CURRENCY & VIRTUAL ITEMS

XSpinZone is a social casino platform for entertainment purposes only. All currency and items are virtual with NO REAL MONEY VALUE. You cannot win real money or prizes, and virtual items cannot be exchanged for real money or anything of value.

VIRTUAL CURRENCY TERMS

VIRTUAL ITEMS DEFINITION

LICENSE TO USE VIRTUAL ITEMS

TERMINATION BY SPINXTREME

 12. GOVERNING LAW & DISPUTE RESOLUTION

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in San Francisco County, California.

DISPUTE RESOLUTION

 MANDATORY ARBITRATION

Any dispute arising from these Terms or your use of XSpinZone shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class actions or jury trials.

2. Arbitration Process: If unresolved, submit to binding arbitration under AAA Consumer Rules
3. Location: Arbitration proceedings in San Francisco, California or via teleconference
4. Costs: Each party bears own costs unless arbitrator determines otherwise

CLASS ACTION WAIVER

YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

EXCEPTIONS

The following disputes are excluded from mandatory arbitration:

TIME LIMITATION

These Terms, together with our Privacy Policy, Cookie Policy, and any other agreements referenced herein, constitute the entire agreement between you and XSpinZone regarding the use of our platform and supersede all prior agreements and understandings.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original.

WAIVER

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision shall not constitute a waiver of such right or provision.

ASSIGNMENT

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign our rights and obligations without restriction. Any attempted assignment in violation of this section is void.

FORCE MAJEURE

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

LANGUAGE

These Terms are written in English. Any translations are provided for convenience only. In case of conflict between the English version and any translation, the English version shall prevail.
